The general conditions of use detailed below, govern exclusively the contractual relations between every user of the site Golfoclic.com (below named "User" or "Bidder") and the site Golfoclic.com.
These general Conditions of use are the only applicable ones and replace quite other conditions, except preliminary, express and written dispensation. CTL Clic can punctually modify some of the measures of these general Conditions of use, also it is essential read it again before every participation in auctions or in auctions of exception organized by the site Golfoclic.com (below named "Site" or " Golfoclic.com").
The site Golfoclic.com belongs to the company CTL clic LTD.
By reaching the site, the User confirms having read and makes a commitment to respect without reserve the general Conditions.
Golfoclic.com is an on-line retail website based on a strategic bids downwards system. The registered users who wish it can buy its products by auction if they proposed the only lowest unique bid, for a participation cost defined before in every product sheet (below named "Bid").
The site Golfoclic.com also offers the possibility to the users registered to acquire some product free of charges The registered users who wish can participate in free bids. The participation cost of these bids is equal to 0€. The final amount of the transaction for the product is also equal to 0€; the only costs of delivery are to be paid by the winner.
For reasons of ease, the term "sales" can be used instead of the terms "Auction" on the user interface of the Site.
At the end of the Sale, which its duration will be, defined before according to the object by Mykitesurf.com, the winning User will have then the possibility of acquiring the object for the amount of the winning Bid.
CTL Clic manages the bids in their entirety (products choice, bid operation..etc.), and makes a commitment to deliver objects gained to their winners. CTL Clic also takes care of the management and the organization of the Site and the data that compose it in their global nature.
For some promotional services, Golfoclic.com saves himself the possibility of restricting these last ones to a part of the users, the selected or not before by the Site.
All the services proposed by Golfoclic.com (below named " proposed Services " or "Services") are considered accepted in their operation, cost and finality by every User.
During the registration is created a user account (below named "Account" or " user Account " or "Account Golfoclic ") in which will appear the personals data and through that the users will be able to use the Services proposed by Golfoclic.com.
By reaching Golfoclic.com, the User guarantees that he acts free of any constraint, guarantees his capacity to approve and subscribe to the present general Conditions and confirms accepting it in their totality. Besides, the user confirms using the Services proposed by Golfoclic.com in a private capacity and he confirms to be major.
The User makes a commitment not to activate and use more than one registered Account Golfoclic. He also makes a commitment on the truthfulness of the supplied information concerning him during his registration or during any modification (name, first name, mailing address, email address or quite other personal data).
The site Golfoclic.com reserves itself the right to forbid a new registration or a connection if the subscriber does not respect the conditions of use (see the conditions detailed in the paragraph 12 of the present General Conditions).
At registration, the User creates a password and uses his e-mail address which will allow him to become identified and to reach his account for the use of the Services proposed by the Site. The User authorizes Golfoclic.com to make the transactions relative to his Account and to any operation made on the Site. The User recognizes to be completely responsible for the confidentiality of his e-mail address and for his password. If somebody seizes passwords and\or e-mail address not belonging to him, neither Golfoclic.com nor CTL CLIC can be considered responsible of the deceitful schemes of this last one. In particular, the diverted credit will not be returned at the account of origin. The User is then recommended to modify his password and e-mail address (via the Site section planned for that purpose) as soon as he thinks that a person has been able to have access to this information.
The user Account can be reloaded in the conditions detailed in the paragraph 8 of the present General Conditions. During these recharging or during sponsoring, CTL CLIC saves itself the possibility of offering to the User a credit upper to the amount of the recharging
If the User decides to close his Account, he has the possibility of making it in his personal space. If the User decides to close his Account or not to use any more the proposed Services, he will not get back the credit of his Account.
Golfoclic.com defines, in its discretion, a use and an restricted access to the site for the unregistered users.
The Site selects objects put in auction according to the system proposed by Golfoclic. Com. Every bid is subjected to a participation cost which the User will have to pay This participation cost is determined by Golfoclic.com before every Sale. So, it will be necessary for every User wishing to go over an object, to have enough credit on his Account. The User will have besides the possibility of going over ranges of Bids. By choosing this function, the Site will generate automatically a Bid included every amount between both extremes fixed by the User with an add of a centime (0,01€), as well as both extremes itselves. Each of these Bids will have the same participation cost like the Bids placed individually.
The User will also have the possibility of outbidding by using a dynamic board, this one allows to display all the positions by edge of euro (of 1 in 2€, 2 in 3€, etc.) and every position are represented by a compartment (0,01; 0,02; 0,03; etc.). Every click on a compartment corresponds to a proposed bid. Once clicked, the compartment lets appear a color pelletize that corresponds to the proposed bid status, it is necessary to wait that the pelletize is well shown to know its position. It is necessary to update and to re-actualize regularly the page to have the dynamic board and the others informations on the bid updated.
Once the operation is made by one of the proposed means, the User cannot remove a Bid, whatever it is, every proposed Bid being definitive. If the Account of the User is not enough furnished to make a part or the totality of the Bids, only the lowest amounts of these bids will be registered, as far as the balance of the Account will allow.
Once the bid is ended, the winning user will receive an email of Golfoclic proposing him 3 choices (not applicable for the free bids):
-1) The purchase of the object for the amount of the bid and the delivery charges
-2) The possibility of receiving a financial corresponding compensation in:
= > transfer Paypal or bank transfer: 50 % of the value of the announced product (50 % of the mean value if several products and models proposed)
= > creditation of 75 % of the announced product value in your Golfoclic account:
(75 % of the mean value if several products and models proposed)
-3) The withdrawal
The bidder who will accept the bid item, authorizes Golfoclic.com to take the amount of the winning Bid more the delivery charge from his Account in case of the balance of this one would allow it.
In the hypothesis of the credit of the Account of the winning User would not be enough to adjust the amount of the winning Bid, an extension of seven days will be offered to the User to reload its account.
After this extension, Golfoclic reserves itself the right to put back the object in auction with refund of the bids of the user.
The bidder who would accept the financial compensation, makes a commitment to supply the information and the modalities of bank transfer to Golfoclic.com for a maximum extension of 7 days by e-mail. In the hypothesis of, desistance from this one or if he does not answer the message of choice in a maximum extension of 7 days, Golfoclic reserves the right to put back the object by auction and then to cancel the transaction.
Every User will see in real time his position on his Bids (not unique bid, unique but too high bid, winning bid at the moment or winning bid at the moment but there are free ranges lower than this offer). His position on the Sale which can change according to the others users bids, the User will have to check his position changes by going on the appropriate pages or by refreshing these last ones if he is already above (his position will be indicated either by sentence, or by emoticons
In the eventuality of no Bid would be only once proposed, the winning Bid would be the lowest amount which would have proposed a minimum number of users. The winning Bidder would be then, of all those who would have gone over this amount, the one who would have proposed in the first one this bid.
Golfoclic.com reserves itself the right to set up one or several bids bonus. These are valid only for the first bidder who offer them and offer the proposed bid (the participation cost for this compartment bonus is not counted)
Golfoclic.com reserves itself the right to set up a 2nd winner for certain proposed bids:
- The 2nd winner will be necessarily another person than 1st winner (winner of the bid of the on sale object)
- The 2nd winner will be the subscriber who will have proposed the lowest and unique bid after the winning bid and, which will not have been proposed by the winner in the bid.
Golfoclic.com reserves itself the right to set up rules that limiting the maximum number of offers which the same subscriber can propose. These limitations have for objective to make the normal bids equitable among the subscribers.
Finally, the winner of the bid is shown in the tab ' ended Bids ' once the completely finished bid, no information given by the site must be considered as a confirmation of gain before the display of the winner in the ' ended Bids '
The free bids work as the bids without participation cost, the proposed offers are free.
The free bids are limited for every registered user, once number of bids is reached, the subscriber cannot participate any more in the free bid.
Once the bid is ended, the winning user will receive an email of Golfoclic proposing him 2 choices:
-1) The product acceptance and the payment of the delivery
charges -2) The withdrawal
The proposed objects are new and authentic. Golfoclic.com tries hard to select the best suppliers and objects put on auctions on the Site. However, neither Golfoclic.com nor CTL CLIC can be considered as persons in charge in case of problem regarding the objects operation. The User can then contact the after-sales service of the manufacturer of the object concerned
Golfoclic.com tries hard to put a description of objects proposed with the biggest loyalty. It is however reminded to the User that this information may contain errors (shells, incomplete descriptions, inaccurate elements etc.) for which neither Golfoclic.com nor CTL CLIC can be considered responsible .In particular, the objects values are given only at informative title, and correspond to the price including tax observed generally in the business.
The dates and times of the beginning and auctions end are the ones of London or Paris. They can then seem inaccurate if the User is situated on a time zone different from London or Paris.
You have to noticed that a gap of some tenth of second can happen, even some seconds between countdowns shown on the screen of the User and official countdowns, i.e. the site servers ones. This possible gap depends on the user browser, his computer performance, the time which this last one spends on the same page without refreshing it. Neither Golfoclic.com nor CTL Clic can be then considered as people in charge in case of distance between the countdowns of the User and those of the Site.
In case of litigation and request on a bid progress in which a subscriber participated, the researches made on the platform and in the engine at the request of the subscriber will be charged to him 20€.
CTL Clic invoices postal charges to the delivery address informed by the User in its personal data if this last one is situated in Europe.
Postal charges are charged in the form of a fixed package for Europe: 15€ for products except Irons set / 30€ for irons set, trolley… The delivery charges have to be pay by a specific recharging (not deductible from a credit of customer account)
The User must be informed that certain countries can demand customs duties which will be charged to him in cost price. However, the difficults transportable objects (car, etc.) will not be delivered, what will be clarified on the page of description of the sale. For certain customizable objects, when it will be specified in the description, the User will have to contact CTL Clic to choose the characteristics before being delivered.
For the rest of the world, and as possible, Golfoclic.com will propose a delivery in own hands of the object or will redirect the User towards a specialized carrier
CTL CLIC does its maximum to have the gained objects delivered within ten working days (except special products such as cars, customizable products, etc.) from the payment of the winning bid and the expenses of delivery in question by the concerned User.
In case of unavailability of the gained object, CTL Clic can, in its discretion, offer in exchange to the concerned User an object of the same range of a superior or equal value, or a sum of money equal to the market value of the object such as he was defined during his auctioning on the Site.
If the object seems to have been delivered in poor conditions, the User will have to warm CTL Clic (by e-mail at the address contact@golfoclic.com, mentioning the object reference in the subject of the message, and the details of the request) and the deliverer (if the damages are discovered to the delivery) at the time of the reception of the parcel. CTL Clic will treat the matter but cannot makes a commitment about the end of the matter.
Golfoclic.com offers several secure payment ways to reload the User Account. It is then possible to proceed to its recharging via the system of secured payment HIPAY (CB, VISA, MASTERCARD, MAESTRO) or via PAYPAL (account to account) or via micro payment (SMS + and audiotel).
By joining on the Site, the User makes a commitment on the truthfulness of the information which he supplies. The communication of false information constitutes a malpractice against the present general Conditions.
The User has a permanent right to access and rectify the information which he had communicate on the site. He can make at any time a request for CTL Clic to know the information detained on himself.
Every user having acquired a prize gives since now its own consent and authorizes Golfoclic.com to treat and to spread the following personal data: his first name, his name, his town … for promoting and communicate about Golfoclic.com activity, through the site and by others communications way such as, press, television, radio, other web sites, etc....
The additional data are: the won prize, the purchase price of the good and possibly the personal picture of the winner with the good
The use of the personal picture of the winner will be the object of a specific request written by Golfoclic.com with the interested
The Brand Golfoclic.com and the logo Golfoclic, the texts of the site Golfoclic.com are the property of CTL CLIC Ltd. All other brands are the property of the respective owners. In no way and for no motive, you can use no registered trademark, intellectual property of CTL CLIC and / or reproduce texts, images or quite other data published on the Site Golfoclic.com, without having received before the written authorization of CTL CLIC Ltd.
The applicable law for any dispute is the one of the head office of the company CTL clic, i.e. the British law.
Besides the previously quoted bans, it is forbidden to the User any manipulation or attempt of manipulation of all or any of the Services proposed by the Site.
In the hypothesis of a fraudulent user would outbid, his Bids would automatically be considered as invalid Besides, if the report of swindle came to be made after the end of a Sale and if this User saw itself victorious, he would not receive the gained object. If however the object had already been sent before, the User would be forced in seven days following the announcement, to send back it to the head office of CTL Clic, at his expenses, new and in its packaging, or to pay it in the value defined on the Site during his auctioning.
CTL Clic reserves itself the right to suspend, to forbid or to cancel the account of every User having or being suspected of braking the rules of the present General Conditions. This malpractice will be determined by CTL Clic in his discretion and will be subject to announcement. If the user Account was on credit, the User could not get back the balance of his Account
If a user uses several customer accounts on the Golfoclic.com site, all his bids will be considered as none. In the case of a winning bid, the sale would be cancelled.
The use of the site Golfoclic.com implies the knowledge and the acceptance of the characteristics and the limits of the internet, in particular as regards the technical performances, time of answer to consult, question or transfer information, the risks of interruption, and more generally, the risks inherent to any connection and transmission on Internet, the absence of protection of certain data against possible diversions and risks of contamination by possible viruses circulating on the network.
So, neither Golfoclic.com nor CTL Clic can be considered as responsible in case of technical problem, and that without limitation of causes (material failure, loss of e-mail, damage caused in the computer of the participant, the problem with internet networks, etc.)..
